Welcome to Mr. Washington Gallery. These Terms of Service (“Terms”) govern your access to and use of this website, Shopify storefront, and any purchases made through Mr. Washington Gallery. By accessing this site or purchasing from us, you agree to be bound by these Terms.
1. Business Overview
Mr. Washington Gallery operates as a curated online gallery and ecommerce storefront offering digital artwork, digital downloads, fine art prints, and other physical or digital creative products.
Product offerings, pricing, descriptions, availability, and fulfillment methods may be modified at any time without notice.
2. Digital Product Delivery
Digital products are delivered electronically following successful purchase and payment confirmation.
By purchasing a digital product, you acknowledge and agree that:
Delivery is fulfilled electronically via digital download
Access may be provided immediately or shortly after payment processing
It is your responsibility to provide accurate purchase and contact information
3. Physical Product Fulfillment
Physical products, including fine art prints and other tangible goods, may be fulfilled directly by Mr. Washington Gallery or through trusted third-party production and fulfillment partners, including but not limited to Pic-Time.
By purchasing physical products, you acknowledge that fulfillment, production, packaging, and shipping may involve third-party service providers.
Additional shipping, production, or fulfillment terms may apply where relevant.
4. Refunds, Returns, and Cancellations
Digital Products:
Due to the instant-access nature of digital products, all digital download sales are final and non-refundable once files have been delivered or made available for download.
Physical Products:
Return, refund, and exchange eligibility for physical products shall be governed by the applicable Return & Refund Policy in effect at the time of purchase.
5. License and Permitted Use
All digital artwork and downloadable content purchased from Mr. Washington Gallery is licensed for personal, non-commercial use only, unless otherwise expressly stated in writing.
Purchase grants a limited, non-exclusive, non-transferable license for personal use only.
6. Prohibited Uses
You may not:
Resell, redistribute, sublicense, share, or transfer digital files
Use purchased artwork for commercial purposes without written permission
Upload purchased files to third-party marketplaces, print-on-demand platforms, or file-sharing services
Modify, reproduce, or create derivative works for resale/distribution
Remove copyright notices or ownership markings
7. Intellectual Property
All artwork, photography, designs, branding, digital files, website content, text, graphics, logos, and related materials are the exclusive intellectual property of Gary Washington / Mr. Washington Gallery and are protected by applicable intellectual property laws.
Purchase does not transfer copyright, ownership, trademark rights, or commercial usage rights.

8. Payment Processing
Payments are securely processed through third-party payment providers, including but not limited to Shopify Payments, Stripe, PayPal, and other integrated payment processors.
Mr. Washington Gallery does not store customers’ full payment card information.
By completing a transaction, you also agree to the applicable terms and privacy policies of the selected payment processor.
9. Taxes and VAT
Prices displayed on this storefront are listed in U.S. Dollars unless otherwise stated and may not include applicable taxes, VAT, duties, or other governmental charges.
Customers are responsible for any applicable taxes, VAT, import duties, or similar charges imposed by their jurisdiction, unless collected by the platform or payment processor at checkout where required by law.
10. Third-Party Services
This website/storefront may utilize third-party platforms, applications, plugins, embedded services, and fulfillment providers to facilitate website operations, ecommerce transactions, digital delivery, production, shipping, analytics, marketing, and customer support.
Mr. Washington Gallery is not responsible for interruptions, delays, errors, or damages caused by third-party service providers beyond our reasonable control.
11. Fraud Prevention and Order Verification
We reserve the right to review order metadata, download records, IP logs, delivery confirmation, transaction history, and related order information for fraud prevention, support verification, abuse prevention, and payment dispute defense.
Orders suspected of fraud, abuse, unauthorized activity, or policy violations may be canceled, restricted, or denied at our discretion.
12. Limitation of Liability
To the fullest extent permitted by law, Mr. Washington Gallery shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from:

Purchase or use of products
Download, delivery, shipping, or fulfillment interruptions
Third-party platform/service/provider failures
Unauthorized use or misuse of purchased products/files by third parties
Our total liability for any claim shall not exceed the amount paid for the product giving rise to the claim.
